Nefarious Success Terms of Service

Nefarious Success is a community engagement bot. In one designated public Discord channel (currently the Nefarious success channel) it:

• watches for image attachments you post;
• downloads that image and any caption you typed;
• publishes them as a public post on the Nefarious X account (@NefariousTrades);
• awards you one leaderboard point per successful post;
• replies so you can open the tweet and, if needed, delete it with a 🗑️ reaction;
• answers the commands !sp, !scl, !sclm, !sclw, !scly so you can see your points and paginated all-time, monthly, weekly, and yearly leaderboards.

The original author, a server administrator, or a member with a designated moderator role can react with 🗑️ on the bot’s reply to delete the X post, remove that point, and delete the related Discord messages.

The bot does not assign or remove Discord roles, does not read online/presence status, and does not scan other channels for message content. Privileged-intent details are on the intents page.

Nefarious Success and Nefarious are not affiliated with, endorsed by, or sponsored by X Corp., Twitter, or any X/Twitter product. “X” and “Twitter” are trademarks of their owners. We use the X API solely to create and delete posts that members choose to share from Discord. X may change, rate-limit, or revoke API access at any time; we are not responsible for X’s availability, ranking, takedowns, or account actions.

Public posts appear on @NefariousTrades (or another X account we operate for the same purpose). Once posted, the content is also subject to X’s Terms and X’s Privacy Policy.

Leaderboard points are a voluntary community score. They are not money, not a stored-value instrument, not a security, not a commodity, and not redeemable for cash, credit, membership, roles, prizes, or any other thing of value. We may change how points are earned, reset boards (including weekly/monthly/yearly windows), correct errors, or discontinue the feature at any time without notice or compensation.

• One successful X post from a qualifying image in the designated channel earns one point.
• Deleting the tweet via 🗑️ removes that point.
• Points are informational only. Rank on a leaderboard does not confer status, rights, or payment.
• We may exclude, reverse, or refuse points for spam, duplicate posts, stolen images, or guideline violations.

You keep ownership of images and captions you post. By posting an image in the designated success channel you instruct us to publish that content publicly on X and grant Nefarious a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt (for example resizing for upload), display, and distribute that content for operating Nefarious Success — including the public tweet, the Discord reply, and leaderboard displays of your Discord name and point total.

You represent that you have the right to post the image and caption, that they do not infringe others’ rights, and that they do not include personal data you are not allowed to share (yours or anyone else’s). Do not post account numbers, unredacted brokerage screens, government IDs, or another person’s private information. The bot’s “sensitive information” reminder is a warning, not a review. We do not promise to catch leaks before they go live.

We may refuse, remove, or decline to tweet any submission, and we may preserve or disclose content if required by law or to protect the community. Report problems to Business@nefarious.trading.

Nefarious Success is a sharing and leaderboard feature. It is not financial, investment, tax, or trading advice. Success screenshots, point totals, and leaderboard rank are individual, often selected outcomes. They are not typical, not verified by us as accurate, and not a promise that you will profit. • You must be at least 18 (or the age of majority where you live, if higher) and allowed to use Discord and X.
• Your use of Discord is also governed by Discord’s Terms of Service and Privacy Policy. You must not use the bot to violate them.
• Do not use the bot to spam, manipulate the leaderboard, impersonate others, or post illegal or non-consensual content.
• We may disable the bot, ignore your posts, or remove your points if you breach these Terms or the Community Guidelines.

The bot depends on Discord and X. We do not control their uptime, APIs, moderation, or media storage. A failed upload, a deleted tweet, or a Discord outage is not a breach of these Terms by us. We do not hold brokerage accounts or process payments through this bot.

Nefarious Success IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT A SCREENSHOT WILL BE POSTED, THAT A TWEET WILL REMAIN UP, THAT POINTS ARE ACCURATE, OR THAT SENSITIVE INFORMATION WILL BE DETECTED OR REMOVED IN TIME.

Without limiting the following, we are not liable for (a) a public tweet that includes information you should have redacted, (b) X or Discord removing or displaying your content, (c) leaderboard errors or resets, or (d) anyone acting on a success screenshot as if it were advice or a typical result.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEFARIOUS, ITS OWNERS, OPERATORS, ANALYSTS, MODERATORS, CONTRIBUTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS (THE “NEFARIOUS PARTIES”) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TRADING LOSSES, LOST TRADING GAINS, LOSS OF CAPITAL, MISSED OPPORTUNITIES, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE, ANY CONTENT, SIGNAL, ALERT, INDICATOR, EDUCATIONAL MATERIAL, RESEARCH, COPY-TRADING ARRANGEMENT, OR THESE TERMS — WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF A NEFARIOUS PARTY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE NEFARIOUS PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO NEFARIOUS (THROUGH WHOP OR OTHERWISE) FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).

Without limiting the above, the Nefarious Parties are not responsible for:

• Your trading decisions. Every trade you place — including trades that copy, mirror, or follow an analyst, alert, indicator, or community discussion — is your own decision and your own risk.
• Third-party platforms. Brokers, exchanges, copy-trading pools, prop firms, Discord, Whop, TradingView, or any other platform you use alongside the Service, including their outages, execution, slippage, fees, liquidations, or account actions.
• Data accuracy and availability. Delays, errors, or omissions in market data, calendars, filings, congressional trade reports, indicator values, or any other information displayed on the Service, or any downtime of the Service.
• Other users. Conduct or content of other members, including in Discord, on comments, or on shared boards.
• Unauthorized access to your Discord, Google, Whop, broker, or exchange accounts, except to the extent caused by our breach of these Terms.

Consumer rights. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, or limit how long an implied warranty lasts. If you are a consumer in such a jurisdiction (including the EU, UK, or certain U.S. states), the limitations above apply only to the extent permitted by law, and nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.

Basis of the bargain. The disclaimers and limitations in these Terms are fundamental elements of the agreement between you and Nefarious; the Service would not be offered (particularly its free tiers) without them. Each limitation applies independently, survives termination of your access, and applies even if any limited remedy fails of its essential purpose.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Nefarious and the Nefarious Parties from claims arising out of your use of Nefarious Success, your screenshots or captions, your violation of these Terms or any law, or your violation of a third party’s rights (including X’s or Discord’s rules).

Informal resolution first: email Business@nefarious.trading and allow 30 days before a formal proceeding.

We may update these Terms by changing the date above and posting the new version at this URL. For material changes we will also note them in Discord when practical. Continued use after the update means you accept the new Terms. If you do not agree, stop using the bot.
