Financial & Trading Disclaimer

This Disclaimer applies to everything published or said by Nefarious, its analysts, moderators, and members — on nefarious.trading, in the Nefarious Discord (text, voice, and live streams), in Whop products, in newsletters and social media, in our indicators and education, and anywhere else we communicate (together, the “Content”). It is part of our Terms of Service.

01Educational content, not advice

All Content is provided for general informational and educational purposes only. It is not, and should not be taken as, financial, investment, trading, tax, accounting, or legal advice, and it is not a recommendation, offer, or solicitation to buy, sell, or hold any security, option, futures contract, currency, digital asset, or other instrument.

Content is general in nature. It does not consider your financial situation, objectives, experience, or risk tolerance, and it is not personalised to you — even when it is delivered as an “alert,” “signal,” “trade idea,” “play,” “watchlist,” “position,” or in a live session, and even when an analyst replies to your question. Any decision to act on Content is yours alone.

02We are not registered advisers or brokers

Nefarious and each of its owners, analysts, moderators, and contributors are not registered investment advisers, broker-dealers, commodity trading advisors, commodity pool operators, introducing brokers, or financial planners. We are not registered with, licensed by, or supervised by the U.S. Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), the Commodity Futures Trading Commission (CFTC), the National Futures Association (NFA), any U.S. state securities regulator, the UK Financial Conduct Authority, or any other financial regulator anywhere in the world.

We do not manage money, hold client funds, execute trades on your behalf, or have discretionary authority over any account. We owe you no fiduciary duty. Our analysts are experienced traders sharing their own process and opinions as publishers and educators, not as your adviser.

03Trading risk disclosure

Trading and investing involve a substantial risk of loss and are not suitable for everyone. You should only trade with money you can afford to lose. Before trading, carefully consider your objectives, experience, and risk appetite, and consult a licensed financial professional.

  • Options are complex instruments. Buyers can lose the entire premium; sellers of uncovered options can lose far more than they receive. Read the OCC’s Characteristics and Risks of Standardized Options before trading options. Short-dated (0DTE / weekly) options can go to zero within hours.
  • Futures are leveraged; small price moves produce large gains or losses, and you can lose more than your margin deposit. Markets may gap or become illiquid, and stops may fill far from their trigger price.
  • Forex trading is highly leveraged and volatile; losses can exceed deposits. Retail forex is restricted or heavily regulated in many countries.
  • Cryptocurrency is extremely volatile, largely unregulated, and subject to exchange failures, hacks, rug pulls, de-listings, regulatory action, and permanent loss of access. Tokens can go to zero. Leveraged crypto perpetuals compound these risks.
  • Small-cap, low-float, and IPO stocks, and situations we track such as dilution, reverse splits, and earnings, involve heightened volatility, halts, and the risk of total loss.
  • Prop-firm evaluations involve fees that are usually non-refundable and rules that can void payouts. Prop firms are third parties; we do not control their terms.

04Copy trading & following analysts

Copy trading, “follow,” or “pool” features on third-party exchanges (including Bybit, Bitunix, BingX, OKX, MEXC, Bitget, and others we may mention) automatically replicate another trader’s trades in your own account. Using them means:

  • you accept every trade the lead trader takes, including trades that lose, without the opportunity to review them first;
  • your fills, fees, slippage, funding costs, and liquidation levels may differ materially from the lead trader’s, so your results will differ from theirs;
  • the lead trader’s past results, win rate, or drawdown do not predict their future performance;
  • the exchange — not Nefarious — controls execution, custody, and risk parameters, and can change or suspend the feature at any time;
  • you must comply with the laws of your country; copy trading and the exchanges offering it are not available or lawful everywhere (including in parts of the United States).

Nefarious does not operate any exchange or copy-trading pool and never holds your funds. Some links to exchanges and prop firms are affiliate links that may pay us a commission if you sign up or deposit; this is a conflict of interest you should weigh. We are not responsible for any third-party platform.

05Past performance, recaps, logs & testimonials

  • Past performance is not indicative of future results. Any trade recap, monthly log, win rate, profit percentage, “R” multiple, or P&L screenshot describes what happened in the past under specific conditions and does not predict what will happen next.
  • Logs and recaps are compiled from alerts and self-reports, are typically calculated on a per-signal basis without accounting for position sizing, commissions, fees, slippage, taxes, or whether a member could actually have entered and exited at the quoted prices. They may contain errors and are not audited.
  • Hypothetical or simulated results (including indicator back-tests and illustrations in education) have inherent limitations: they are prepared with hindsight, do not reflect actual trading, and do not account for the impact of market liquidity or emotional decision-making. No representation is made that any account will or is likely to achieve results similar to those shown.
  • Testimonials and reviews (including Whop reviews and member messages shown on the website) reflect the individual experience of the person quoted. They are not typical, are not a guarantee of future results, and were not compensated unless stated. Your results will vary and may include losses.
  • Nothing is guaranteed. No one at Nefarious can or will guarantee profits, returns, or the avoidance of losses. Anyone claiming otherwise in our name is not speaking for us.

06Analyst positions & conflicts of interest

Our analysts and staff actively trade. They may hold, buy, or sell positions in the instruments discussed — before, during, or after they are discussed — and may trade in a manner inconsistent with the Content (for example, exiting a position they recently discussed). Tools such as the Position Manager and trading logs show one trader’s own positions and reasoning for educational transparency; they are not recommendations for you.

We may receive affiliate commissions, sponsorship, or other compensation from exchanges, brokers, prop firms, or other partners we mention. We do not accept payment to promote specific securities or tokens.

07Indicators, data & tools

Indicators

Our custom indicators (including GEX, options-level, and trend tools) are analytical aids that display derived data. They do not generate buy or sell recommendations, can produce false or late signals, and depend on third-party data that may be delayed or wrong. They run on TradingView, an independent platform; TradingView® is a trademark of TradingView, Inc., which is not affiliated with and does not endorse Nefarious.

Market and public data

Earnings, IPO, dilution, split, congressional-trading, economic-calendar, interest-rate, schedule, and price data are sourced from third parties and public records (for example Yahoo Finance, Nasdaq, SEC EDGAR, and government publications). Data may be delayed, incomplete, revised, or inaccurate, and filing dates can change. We do not verify third-party data and are not responsible for errors. Ticker logos and company names are the property of their owners. Nefarious is not affiliated with Earnings Whispers or any data source.

Education

Courses, videos, quizzes, and written volumes teach general concepts and one way of approaching markets. Completing them does not qualify you as a professional trader, and applying the concepts may still result in losses.

08Your responsibility

  • Do your own research and verify anything you read here before acting on it.
  • Consult a licensed financial adviser, tax professional, or attorney about your specific situation.
  • Understand the products you trade and the rules of your broker or exchange, including margin, liquidation, and pattern-day-trader rules.
  • Know and follow the laws of your own country, including whether a given product, exchange, or copy-trading service is legal for you to use.
