Terms of Service

The Service is provided by Nefarious / Nefarious Trading, operator of nefarious.trading (“Nefarious,” “we,” “us”). These Terms form a binding agreement between you and Nefarious. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

You must be at least 18 years old (or the age of majority where you live) to use member and trading community features. The Service is not intended for children. You are responsible for complying with laws that apply to you, including securities, derivatives, and gambling/trading rules in your jurisdiction.

Certain features require signing in with Discord OAuth. You are responsible for the Discord account you use, for keeping access to that account secure, and for activity under your session. We may deny, suspend, or revoke access if we reasonably believe your account is compromised, shared improperly, or used in violation of these Terms.

Access to VIP tools may depend on Whop membership status, Discord roles, and/or allowlists. Membership purchases and billing are generally handled by Whop under Whop’s terms; we determine feature access on the Service based on membership and role checks.

Depending on your access level, the Service may include:

• Public pages about the Nefarious community, research/blog content, and marketing materials
• Discord community links and Whop membership entry points
• Member tools such as congress trading views, economic calendar, interest rates, Trump schedule, affiliates, and related research utilities
• Workout tracker (logs, routines, measures, statistics, leaderboards, Discord share cards)
• Optional future Google Health integration for steps and sleep
• Other features we add, change, or remove over time

We may modify, suspend, or discontinue any part of the Service at any time, including for maintenance, security, or product changes.

Trading & market content

Content on the Service — including signals, research, calendars, congress trading data, rates, schedules, copy-trading information, testimonials, and community discussion — is for informational and educational purposes only. Nothing we provide is personalized financial, investment, tax, or legal advice. Trading involves substantial risk of loss. Past performance is not indicative of future results. You alone are responsible for your trading decisions.

Workout & health content

The workout tracker, exercise science content, rankings, measures, leaderboards, and any steps/sleep displays are not medical advice and are not a substitute for professional healthcare, physical therapy, or personalized training advice. Consult a qualified professional before beginning exercise programs, especially if you have injuries or medical conditions. Use fitness features at your own risk.

Free or paid membership tiers may be offered via Whop or other channels. Benefits, pricing, and cancellation rules for purchases are primarily governed by the checkout flow and Whop’s terms. Site-side VIP access is a privilege tied to valid membership, Discord identity, and our access rules. We may correct access errors, remove abusive accounts, and update which tools require VIP.

Affiliate tools and partner links may include tracking or commercial relationships. We are not responsible for third-party products, brokers, prop firms, or offers you choose to use.

If you use the workout tracker, you agree that:

• You will only submit accurate information you are authorized to provide
• Leaderboards and community features may display certain aggregates or activity associated with your Discord identity
• Optional “Send to Discord” / webhook shares are initiated by you and may post images or summaries to Nefarious Discord channels visible to other members
• We may moderate, remove, or restrict workout content or access for abuse, spam, or safety reasons

If you choose to connect Google Health (or related Google OAuth scopes) for steps and sleep, you authorize us to receive those metrics solely to provide the fitness features described in our Privacy Policy. You can revoke access through Google and request deletion from us. Misuse of health APIs, or attempting to access another person’s health data, is prohibited.

You agree not to:

• Violate laws or third-party rights
• Attempt unauthorized access to accounts, APIs, databases, or admin tools
• Scrape, overload, or disrupt the Service except through documented public interfaces we allow
• Share VIP credentials, bypass paywalls/role gates, or resell access without permission
• Upload malware, spam, or abusive content
• Impersonate others or misrepresent affiliation with Nefarious
• Use the Service to provide regulated investment advice under our brand without authorization
• Reverse engineer the Service except where such restriction is prohibited by law
• Use health or workout data features for surveillance, discrimination, or other unlawful purposes

The Service — including branding, UI, logos, original research formatting, software, and original content we create — is owned by Nefarious or its licensors. You receive a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes (unless we expressly grant commercial rights, e.g. approved affiliates).

If you submit feedback or content to us, you grant Nefarious a worldwide, royalty-free license to use that feedback/content to operate and improve the Service, subject to the Privacy Policy.

The Service integrates or links to third parties including Discord, Whop, Vercel, Google, social platforms, brokers, prop firms, and affiliates. We do not control third-party services and are not liable for their availability, content, or practices. Your dealings with third parties are solely between you and them.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MARKET/WORKOUT/HEALTH DATA WILL BE COMPLETE OR ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEFARIOUS AND ITS OPERATORS, CONTRIBUTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOST PROFITS, LOST TRADING GAINS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS — WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO NEFARIOUS (IF ANY) FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

You agree to defend, indemnify, and hold harmless Nefarious and its operators from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your trading or fitness decisions, your content, or your violation of these Terms or applicable law.

We may suspend or terminate your access at any time if we believe you violated these Terms, pose a security risk, or if membership/role checks fail. You may stop using the Service at any time and may request account-related data deletion as described in the Privacy Policy. Provisions that by nature should survive (including disclaimers, liability limits, indemnity, and governing law) will survive termination.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except where mandatory local consumer protections apply. Courts located in Delaware (or another U.S. venue we mutually agree in writing) will have exclusive jurisdiction over disputes, except that either party may seek injunctive relief in any jurisdiction for unauthorized access or IP misuse.

Before filing a formal dispute, please contact Business@nefarious.trading so we can try to resolve the issue informally.

We may update these Terms from time to time. The “Last updated” date will change when we do. Material changes may be posted on this page. Continued use after changes become effective constitutes acceptance of the updated Terms.

• If any provision is unenforceable, the remainder remains in effect.
• Failure to enforce a provision is not a waiver.
• You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the Service.
• These Terms, together with the Privacy Policy and any feature-specific notices, are the entire agreement regarding the Service.
