Terms of Service

The Service is operated by Nefarious Digital, the entity behind the Nefarious brand and nefarious.trading. If you use the Service on behalf of a business, you represent that you have authority to bind it, and “you” includes that business.

• You must be at least 18 years old (or the age of majority where you live, if higher) to use the Service. Trading education and community discussion of leveraged products are not appropriate for minors. The Service is never directed to children under 13.
• You must be able to lawfully use Discord, Whop, and any broker or exchange you choose, and you are responsible for complying with the securities, derivatives, tax, and consumer laws that apply to you where you live.
• You may not use the Service if you have previously been removed from the Nefarious Discord or banned from the Service, or if you are a person or entity with whom we are prohibited from dealing under applicable sanctions laws.

We do not operate a separate username/password system. Member tools use Discord OAuth: when you sign in, Discord tells us your Discord ID, username, avatar, and your roles in the Nefarious server, and we store that identity in a signed session cookie (details in the Privacy Policy). Access to gated tools depends on your Discord roles and on whether Whop reports an active membership linked to your Discord account.

• You are responsible for the security of your Discord, Google, Whop, and broker accounts and for everything done under your session.
• Do not share, lend, or sell access to your account, your Discord roles, or any gated content.
• Do not sign in as anyone else or use another person’s Discord account.
• Tell us promptly if you believe your account has been compromised.
• Role and membership checks are refreshed periodically; a change in your Whop status or Discord roles may take some time to reflect on the site.

Depending on your membership tier and Discord roles, the Service may include:

• Public pages: research articles, education, market tools (earnings, IPOs, dilution, reverse splits), analyst profiles, testimonials, pricing, and marketing content
• The Nefarious Discord server: text and voice channels, live trading sessions, alerts, and community discussion
• Whop products: free and paid memberships that unlock Discord roles and site tools
• Custom TradingView indicators and scripts (such as GEX, options levels, and trend tools) and related setup guides and videos
• Member tools: congress trading tracker, economic calendar, interest-rate tracker, Trump schedule, Position Manager, skew map, SniperYos watchlist, Traders Hub, and similar utilities
• The workout tracker and health leaderboards, including optional Google Fit connection and Discord share cards
• Staff and moderator tools such as the collaborative whiteboard, blog editor, planner, and affiliate dashboards
• Newsletter emails you opt in to, and other features we add over time

We may add, change, limit, or discontinue any part of the Service at any time, including which tools require a paid membership, without liability to you. Free tiers are provided at our discretion and can be withdrawn.

Paid memberships are sold, billed, and renewed by Whop (whop.com), a third-party marketplace. When you buy through Whop you also agree to Whop’s terms and are billed on the schedule shown at checkout (for example weekly or monthly, auto-renewing until cancelled). We do not receive or store your card number.

• Cancellation. You can cancel a recurring membership at any time from your Whop account. Cancellation stops future renewals; access continues until the end of the period you already paid for, after which the linked Discord roles and site access are removed automatically.
• Refunds. Refunds are handled through Whop and are governed by Whop’s refund policy and the refund terms displayed on the specific product page at the time of purchase. Except where the law requires otherwise, digital content and community access that has already been delivered is non-refundable, and partial periods are not prorated.
• Price changes. We may change prices or what is included in a tier. For recurring plans, changes apply from your next renewal after notice through Whop or the Discord.
• Chargebacks. Please contact us or Whop before disputing a charge. Opening a chargeback while continuing to use the Service, or after receiving the content, may result in termination and referral of the dispute to Whop.
• Affiliates. Some members earn commissions for referrals under a separate affiliate arrangement. Commissions are calculated from Whop payment data, may be held or reversed if the underlying payment is refunded or disputed, and are paid at our discretion under the affiliate terms communicated to affiliates.

Our right to suspend or terminate

We may suspend, restrict, or terminate your access to any part of the Service — including removing you from the Nefarious Discord, revoking Discord roles, signing you out of the website, blocking your Discord ID from site tools, and cancelling your Whop membership — at any time, with or without notice, if we reasonably believe that:

• you have breached these Terms, the Community Guidelines, or applicable law;
• you are engaging in market manipulation, scams, impersonation, harassment, or conduct that harms other members or the community;
• you are sharing, reselling, or leaking paid content, indicators, alerts, or Discord access;
• your account is compromised, used by someone else, or associated with a chargeback or fraud;
• we are required to do so by law, by Discord, or by Whop; or
• we discontinue the Service or the relevant feature.

For minor first-time issues we will usually warn, mute, or time you out first, but we are not required to follow any particular sequence.

Your right to leave

You may stop using the Service at any time by leaving the Discord server, signing out of the website, and cancelling any recurring membership in Whop. You may also ask us to delete personal data we hold about you as described in the Privacy Policy.

Effect on paid memberships

• If you cancel, you keep access until the end of the current paid period; no refund is due for the remainder except where Whop’s policy or applicable law provides one.
• If we terminate you for breach, we may cancel your membership immediately and you are not entitled to a refund for the remaining period, to the extent permitted by law.
• If we discontinue a paid product for reasons unrelated to your conduct, we will ask Whop to refund any prepaid amount covering the period after discontinuation, or offer an equivalent replacement.
• Any refund is processed by Whop through your original payment method under Whop’s refund policy.

After termination

Your licence to use our content ends, gated pages stop working, and we may delete or retain your content and data as described in the Privacy Policy. Sections that by their nature should survive (including the disclaimers, limitation of liability, indemnity, intellectual-property, and governing-law provisions) survive termination.

The Service lets you post and share content: Discord messages and voice, research and watchlist comments, whiteboard items and comments, quiz answers, workout logs and share cards, exercise requests, and anything else you submit (“User Content”). The full rules are in our Community Guidelines, which are part of these Terms. In short:

• No market manipulation, pump-and-dump schemes, coordinated buying or selling, or spreading false or misleading information about any security, token, or market.
• No impersonating Nefarious staff, analysts, or other members; no fake giveaways, phishing, or DM scams.
• No harassment, hate, threats, doxxing, sexual content, or illegal content.
• No spam, unsolicited advertising, or promoting competing paid signal services.
• Only post content you have the right to post.

Licence you grant us

You keep ownership of your User Content. You grant Nefarious a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, adapt, and distribute your User Content for the purposes of operating, promoting, and improving the Service — for example displaying your comment to other members, showing your username on a leaderboard, posting your workout share card in Discord at your request, or quoting a review in our marketing. This licence ends when you delete the content or your account, except for (i) copies already shared with other members or the public, (ii) content used in marketing before deletion, and (iii) backups retained for a limited period.

Our rights over User Content

We may review, moderate, edit for formatting, remove, or refuse any User Content at our discretion, and may preserve or disclose it if required by law or to protect the Service and its members. We are not obliged to monitor content and are not responsible for content posted by members. To report content or request a takedown, email Business@nefarious.trading or use the reporting process in the Community Guidelines.

Everything on the Service — alerts, trade ideas, live sessions, indicators, education, research, congressional or market data, the Position Manager, copy-trading information, trading logs, and community discussion — is provided for informational and educational purposes only. It is general in nature and does not take your personal circumstances into account. Nothing on the Service is a recommendation to buy, sell, or hold any security, option, future, currency, or digital asset, or an offer or solicitation of any kind.

• Nefarious and its analysts are not registered investment advisers, broker-dealers, commodity trading advisors, or financial planners, and are not registered with the SEC, FINRA, CFTC, NFA, or any other regulator. We have no fiduciary duty to you.
• Trading stocks, options, futures, forex, and cryptocurrency involves substantial risk, including the loss of more than your initial investment when leverage is used. You could lose all of your money.
• Past performance, trade recaps, logs, win rates, and testimonials are not indicative of future results and are not typical.
• Copy trading and “follow” features on third-party exchanges execute trades in your account automatically; you bear all risk of those trades and of the platform.
• Analysts and staff may hold, buy, or sell positions in the instruments they discuss, before or after discussing them.
• You are solely responsible for your trading decisions and should consult a licensed professional before acting on anything you learn here.

The Service and everything we create for it — including the Nefarious name and logos, the website design and code, our indicators and scripts (including GEX, options-level, and trend tools), education courses, written volumes and videos, research articles, watchlists, trade recaps, graphics, and compilations of data — are owned by Nefarious or our licensors and protected by copyright, trademark, and other laws.

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service and its content for your personal, non-commercial trading education while you remain a member in good standing. You may not copy, record, screenshot for redistribution, share, resell, sublicense, publicly display, scrape, or use our content to train machine-learning models, and you may not share or republish indicator access, invite codes to paid channels, or alert content outside the community. TradingView is a trademark of TradingView, Inc.; Discord, Whop, Google, and other names are the property of their respective owners, and none of them sponsors or endorses Nefarious.

The Service depends on and links to third parties we do not control: Discord, Whop, Google, TradingView, Vercel, our database provider, market-data sources, video hosts, brokers, exchanges, copy-trading pools, and prop firms. Your use of them is governed by their own terms and privacy policies. We are not responsible for their availability, accuracy, execution, fees, security, or conduct.

Some links on the Service are affiliate or referral links (for example to exchanges, copy-trading platforms, or prop firms). If you sign up or deposit through them we may receive a commission or fee share at no additional cost to you. This relationship does not change our assessment of a platform, but you should treat it as a potential conflict of interest and do your own due diligence. We never hold your funds.

In addition to the Community Guidelines, you agree not to:

• access or attempt to access accounts, APIs, databases, admin or staff tools, or gated pages you are not authorised to use, or bypass role, membership, or rate-limit checks;
• scrape, crawl, bulk-download, or mirror the Service, or use bots or automated tools against it except as we expressly allow;
• interfere with, overload, or disrupt the Service or the Discord, or upload malware;
• reverse engineer, decompile, or extract the source of our indicators or software, except where the law grants you that right;
• use the Service to give regulated investment advice, run a competing signal service, or solicit members for other paid groups;
• use the workout, health, or leaderboard features to harass, surveil, or discriminate against anyone;
• misrepresent your affiliation with Nefarious or use our marks without written permission; or
• violate any law, regulation, or third-party right.

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT ALERTS WILL BE DELIVERED OR ACTED ON IN TIME; THAT INDICATORS WILL PERFORM AS DESCRIBED; THAT MARKET, FILING, CALENDAR, WORKOUT, OR HEALTH DATA WILL BE ACCURATE OR COMPLETE; OR THAT USING THE SERVICE WILL RESULT IN PROFITS OR AVOID LOSSES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEFARIOUS, ITS OWNERS, OPERATORS, ANALYSTS, MODERATORS, CONTRIBUTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS (THE “NEFARIOUS PARTIES”) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TRADING LOSSES, LOST TRADING GAINS, LOSS OF CAPITAL, MISSED OPPORTUNITIES, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE, ANY CONTENT, SIGNAL, ALERT, INDICATOR, EDUCATIONAL MATERIAL, RESEARCH, COPY-TRADING ARRANGEMENT, OR THESE TERMS — WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF A NEFARIOUS PARTY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE NEFARIOUS PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO NEFARIOUS (THROUGH WHOP OR OTHERWISE) FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).

Without limiting the above, the Nefarious Parties are not responsible for:

• Your trading decisions. Every trade you place — including trades that copy, mirror, or follow an analyst, alert, indicator, or community discussion — is your own decision and your own risk.
• Third-party platforms. Brokers, exchanges, copy-trading pools, prop firms, Discord, Whop, TradingView, or any other platform you use alongside the Service, including their outages, execution, slippage, fees, liquidations, or account actions.
• Data accuracy and availability. Delays, errors, or omissions in market data, calendars, filings, congressional trade reports, indicator values, or any other information displayed on the Service, or any downtime of the Service.
• Other users. Conduct or content of other members, including in Discord, on comments, or on shared boards.
• Unauthorized access to your Discord, Google, Whop, broker, or exchange accounts, except to the extent caused by our breach of these Terms.

Consumer rights. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, or limit how long an implied warranty lasts. If you are a consumer in such a jurisdiction (including the EU, UK, or certain U.S. states), the limitations above apply only to the extent permitted by law, and nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.

Basis of the bargain. The disclaimers and limitations in these Terms are fundamental elements of the agreement between you and Nefarious; the Service would not be offered (particularly its free tiers) without them. Each limitation applies independently, survives termination of your access, and applies even if any limited remedy fails of its essential purpose.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Nefarious and the Nefarious Parties from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your trading or investment decisions, (c) your User Content, (d) your violation of these Terms, the Community Guidelines, or any law, or (e) your violation of any third party’s rights.

Informal resolution first. Before starting any formal proceeding, you agree to email Business@nefarious.trading with a description of the issue and give us 30 days to try to resolve it.

Consumer rights. If you are a consumer in the EU, UK, or another place whose mandatory consumer-protection law gives you rights that cannot be waived by contract (including the right to bring proceedings in your home courts), nothing in these Terms takes those rights away.

We may update these Terms from time to time. When we do, we will change the “Last updated” date above and, for material changes, post a notice in the Discord announcements channel or on the website at least 7 days before they take effect (unless a change is required by law or is needed to address a security or abuse issue, in which case it may take effect immediately). Continued use of the Service after the effective date means you accept the updated Terms. If you do not agree, stop using the Service and cancel any membership.

• Entire agreement. These Terms, the Privacy Policy, Community Guidelines, Financial Disclaimer, Copyright & DMCA notice, and any product-specific terms shown at checkout are the whole agreement between you and Nefarious regarding the Service.
• Severability. If any provision is unenforceable, it will be enforced to the maximum extent permitted and the rest remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of the Service.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of Discord, Whop, Vercel, exchanges, or data providers.
• Notices. We may notify you via the Discord, the website, Whop, or the email address you gave us. You may notify us at Business@nefarious.trading.
• Language. These Terms are written in English; any translation is for convenience only.
