This notice explains what Nefarious owns, what you are allowed to do with it, how we credit third parties, and how to report copyright infringement. It forms part of our Terms of Service.

01What we own

Unless otherwise noted, all content and materials on the Service are the property of Nefarious or its licensors and are protected by U.S. and international copyright, trademark, trade-secret, and other intellectual-property laws. This includes:

  • Indicators and software — our custom TradingView indicators and scripts (including the GEX / gamma-exposure tools, institutional options-level tools, trend identifiers, and key-level indicators), their source code, logic, parameters, colour schemes, and documentation, whether delivered as invite-only scripts or otherwise.
  • Education — courses, written volumes, lesson pages, setup guides, quizzes, slides, and all tutorial and course videos, including videos hosted on our CDN or embedded from third-party video platforms.
  • Research and publications — blog and research articles, newsletters, watchlists and watchlist PDFs, trade recaps and logs, highlights, alerts, and analyst commentary.
  • Data compilations and tools — the selection, arrangement, and presentation of data in our market tools (earnings, IPO, dilution, splits, congress trading, calendars, skew map, Position Manager), even where the underlying facts are public.
  • Brand and design — the Nefarious name, logos, the look and feel of the website and Discord, graphics, share-card designs, and the site’s source code.
  • Recordings — live trading sessions, voice-channel streams, and any recordings or clips of them.

02What you may — and may not — do

Permitted

  • View and use the content for your own personal, non-commercial trading education while you are a member in good standing.
  • Use our indicators on your own TradingView account for your own trading, subject to the access rules of your membership tier.
  • Share links to our public pages, and quote short excerpts of public articles with attribution and a link back.
  • Post your own charts using our indicators inside the Nefarious community.

Not permitted without our written consent

  • Copying, re-uploading, screen-recording, or distributing courses, videos, watchlists, research, alerts, or live sessions — including in other Discords, Telegram groups, forums, or file-sharing sites.
  • Sharing, transferring, reselling, or “group-buying” indicator access; reverse engineering, decompiling, or re-implementing our indicators; or publishing their source or logic.
  • Forwarding paid-channel alerts or content outside the community, or operating a service that relays them.
  • Scraping, crawling, or bulk-downloading the website or its data, or using any of our content to train or fine-tune AI/ML models.
  • Removing copyright, watermark, or attribution notices; or using our name, logo, or analysts’ names to imply endorsement of your product or service.
  • Commercial use of any content, including in paid courses, signal services, or advertising.

Breach of these rules is a breach of the Terms of Service, may result in immediate termination without refund, and may expose you to civil and criminal liability. We actively pursue leaks of paid content. To request a licence or permission, email Business@nefarious.trading.

03Trademarks & third-party marks

“Nefarious,” “Nefarious Trading,” the Nefarious logo, and our product and indicator names are trademarks or trade names of Nefarious Digital. You may not use them without prior written permission, except to refer to us truthfully in plain text.

Third-party names and marks that appear on the Service belong to their respective owners, none of whom sponsors, endorses, or is affiliated with Nefarious:

  • TradingView® is a registered trademark of TradingView, Inc. Our indicators run on the TradingView platform; TradingView does not create, review, or endorse them.
  • Discord® is a trademark of Discord Inc.; Whop is a trademark of Whop, Inc.
  • Google, Google Fit, and YouTube are trademarks of Google LLC.
  • Yahoo Finance, Nasdaq, SEC EDGAR, Earnings Whispers, Finnhub, Financial Modeling Prep, and other data sources are marks of their owners; company names, tickers, and logos shown in our market tools belong to the respective issuers.
  • Bybit, Bitunix, BingX, OKX, MEXC, Bitget, and any brokers, exchanges, or prop firms we mention are marks of their owners.

04Third-party & member content

  • Embedded videos from YouTube or other platforms remain the property of their uploaders and are shown under those platforms’ embedding terms.
  • Public data (SEC filings, congressional disclosures, economic releases, price data) is not owned by us; we claim rights only in our selection, arrangement, and presentation.
  • Member content (comments, Discord posts, whiteboard items, workout shares, reviews) belongs to the member who posted it, licensed to us under Section 7 of the Terms. Members are responsible for ensuring they have the right to post it.
  • Fair use. Where we quote or display third-party material (for example a headline, chart, or filing excerpt) for commentary, criticism, or education, we do so in reliance on fair use and similar doctrines. If you believe we have overstepped, use the process below.

05Reporting infringement (DMCA notice & takedown)

We respect the intellectual-property rights of others and respond to notices that comply with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent laws. If you believe content on the Service (including member-posted content) infringes your copyright, send a written notice by email:

Your notice must include:

  • your physical or electronic signature (typing your full name is sufficient);
  • identification of the copyrighted work you claim has been infringed (or a representative list if there are several);
  • the exact URL, Discord message link, or other location of the material you want removed, with enough detail for us to find it;
  • your name, address, telephone number, and email address;
  • a statement that you have a good-faith belief that use of the material is not authorised by the copyright owner, its agent, or the law; and
  • a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.

On receipt of a valid notice we will remove or disable access to the material, notify the member who posted it, and record the notice. Please note that under 17 U.S.C. § 512(f) you may be liable for damages if you knowingly misrepresent that material is infringing.

Counter-notice

If your content was removed and you believe this was a mistake or that you have the right to post it, you may send a counter-notice to the same email containing: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; your name, address, and phone number; and a statement that you will accept service from the complainant. We may restore the material in 10–14 business days unless the complainant tells us they have filed a court action.

Repeat infringers

We terminate, in appropriate circumstances, the accounts and Discord access of members who are repeat infringers.

06Reporting misuse of our content

If you find our indicators, courses, videos, alerts, or research being shared, sold, or re-uploaded without permission — on Discord, Telegram, YouTube, file-sharing sites, or anywhere else — please email Business@nefarious.trading with a link. Reports are treated confidentially.
