Nefarious Widget Terms

Nefarious Widget is a voice-chat counter for streams and site embeds. It is not a command bot and not a public App Directory product. Operators set a Discord bot token and one voice channel id (default 1492973945190748411). The process:

• Logs into Discord with intents.guilds and intents.voice_states only.
• On ready and on each on_voice_state_update, counts len(channel.members) for that one voice channel.
• Serves GET /api/voice-count as JSON (ready, count, channelId, channelName, guildName, updatedAt, error) and a small HTML overlay that polls every 5 seconds.

The overlay shows a live number labeled “in voice right now.” It does not list names, play audio, or reply in chat. Watched channel (if you are in the Nefarious guild): https://discord.com/channels/909011353342181426/1492973945190748411.

A voice headcount, “Live” badge, or stream overlay is not financial, investment, tax, or legal advice and is not a recommendation to buy, sell, or hold any instrument. Nefarious and the operators of this bot are not registered investment advisers, broker-dealers, or commodity trading advisors.

You accept that:

• The bot, Discord gateway, or overlay host can fail, so the number may freeze, drop to zero, or never update.
• Voice-state cache can miss a join or leave, or fail to resolve a member object, so the count can be short.
• The overlay polls on an interval; it is not tick-by-tick.
• Past uptime is not a promise of future uptime.

We are not liable for trades, missed trades, or other decisions made after seeing the overlay.

Nefarious Widget runs on Discord. Your use of Discord is governed by Discord’s Terms of Service and Community Guidelines. Nothing here overrides Discord. We may remove the bot, rotate tokens, or change the watched channel to stay within Discord’s platform rules, including privileged-intent limits.

Discord’s privileged-intent form asks why a bot needs Message Content, Server Members, or Presence. This bot does not need those three. The client is constructed with discord.Intents.none(); intents.guilds = True; intents.voice_states = True. Voice States is a standard intent. Counting occupants of one voice channel is not Server Members and is not Presence.

Privileged intents

• Message Content: not used. widget_server.py never enables intents.message_content and has no on_message, prefix, or slash-command handler. The overlay is driven by a voice-count API, not by reading Discord messages.
• Server Members: not used. intents.members is not set. The bot does not welcome members, assign roles, or enumerate the guild member list. Occupant count comes from VoiceChannel.members, which discord.py fills from the voice-state cache after intents.voice_states = True — a standard intent, not Server Members.
• Presence: not used. The bot never reads online, idle, DND, or streaming status. intents.presences is not set. A live count of people in one voice channel is not Presence.

What we actually use

• Guilds — resolve the configured voice channel id after login
• Voice States — on_voice_state_update refreshes len(channel.members) for that one channel

You may not use Nefarious Widget or its overlay to:

• Present a voice count as personalized advice, a solicitation, or a guaranteed outcome.
• Attack, scrape, or overload the overlay host, the bot, or Nefarious.
• Violate Discord’s rules or applicable law.

Operators may mute, move, or remove the bot at any time. We may stop the process without notice.

THE BOT AND EVERY OVERLAY COUNT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT AN UNINTERRUPTED OR CORRECT HEADCOUNT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEFARIOUS AND ITS OWNERS, OPERATORS, ANALYSTS, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR TRADING LOSSES, LOST PROFITS, MISSED TRADES, OR LOST DATA, ARISING FROM THE BOT, THE OVERLAY, A WRONG COUNT, OR THESE TERMS — EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL LIABILITY FOR CLAIMS RELATING TO Nefarious Widget WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE BOT IN THE THREE MONTHS BEFORE THE CLAIM (typically none; the bot is not sold as a standalone product) OR (B) FIFTY U.S. DOLLARS (USD $50).

Some places do not allow certain limitations. Those limits apply only as far as local law allows. Nothing here excludes liability that cannot be excluded (including fraud). This section works with the site-wide limitation of liability and Section 13 of the site Terms.

We may update these Terms by posting a new version at this URL. The “Last updated” date will change. Continued use after an update is acceptance. If a change is material we will try to note it on the legal hub.

Running code in widget_server.py exposes GET /api/voice-count with a numeric count and does not send Discord messages. The HTML overlay in public/index.html polls that API and renders the number next to “in voice right now.”
